Same-Sex Marriage and Religious Liberty explores the religious freedom implications of defining marriage to include same-sex couples. It represents the only comprehensive, scholarly appraisal to date of the church-state conflicts virtually certain to arise from the legal recognition of same-sex marriage. It explores two principal questions. First, exactly what kind of religious freedom conflicts are likely to emerge if society embraces same-sex marriage? A redefinition of marriage would impact a host of laws where marital status affects legal rights_in housing, employment, health-care, education, public accommodations, and property, in addition to family law. These laws, in turn, regulate a host of religious institutions_schools, hospitals, and social service providers, to name a few_that often embrace a different definition of marriage. As a result, church-state conflicts will follow. This volume anticipates where and how these manifold disputes will arise. Second, how might these conflicts be resolved? If the disputes spark litigation under the Free Speech, Free Exercise, or Establishment Clauses of the First Amendment, who will prevail and why? When, if ever, should claims of religious liberty prevail over claims of sexual liberty? Drawing on experience in analogous areas of law, the volume explores whether it is possible to avoid these constitutional conflicts by statutory accommodation, or by separating religious marriage from civil marriage.

The narrative re-tellings of the life, reign, and death of the English King Edward II (reigned 1307–1327) present a unique opportunity for scholars of sexuality in the early modern era. This is because the works of authors like Christopher Marlowe, Michael Drayton, Sir Francis Hubert, Elizabeth Cary, and Richard Niccols were all inspired by the public, cultural memory fashioned from Edward’s same-sex love affair with Piers Gaveston. As such, each of them presents a particular representation of and a specific discourse about male-male sexual relations in the Renaissance. In other words, what these works present is a concentrated body of literature about same-sex love in the early modern era: works that openly and frankly explore the possible origins of the love, the reasons and causes for it; works that explore the ramifications of male-male romantic relationships; works that explore the sexual politics and sociocultural dynamics of same-sex romantic partnerships; and works that describe and denote same-sex love from an English Renaissance perspective. This study looks at each of the major Renaissance texts about Edward II and examines the means through which each text understands and analyzes the nature of male-male same-sex love. From Marlowe’s crafting of a lover-identity for Edward to Drayton’s obsession with Marlowe’s version of (gay) history; from Hubert’s Augustinian construction of Edward’s nature to Cary’s identification with the fallen king to Niccols’ inspired exemplum, what each of these works demonstrates is that the “love that dare not speak its name” would not be silenced, at least not in the case of Edward and Gaveston. When one sees the name Edward II, one also sees his same-sex loves. The correlation has become ingrained into our public recall of history. Thus, as far as the world is concerned, Edward II was—and ever will be—the gay king.

This book examines the proliferation of policy making concerning the recognition and protection of same-sex relationships in the countries of North and South America, adding to the knowledge of developments in the United States and Canada, but, mostly notable, exploring more recent developments in Mexico, Central and South America, and the Caribbean. While much work has been done on developments in Europe and upper North America, this book attempts to broaden the understanding of relationship equality policy proliferation around the world and to add new insights regarding the policies of sexuality in different national contexts. The book discusses the several factors that have constrained and facilitated policymaking in this area including legal systems, public opinion, political culture, and, more particularly, the role of religion as a key obstacle in the recognition of rights for same-sex couples. The chapters also explore the role of institutional mechanisms, political parties, NGOs, IGOs, and international norms as significant factors for policy adoption This book explores policy innovation for same-sex couples throughout the Americas and includes same-sex marriage legislation, civil unions, and other new developments for same-sex couples throughout the Americas at both national and sub-national levels. This scholarship is innovative because though much has been written regarding developments in North America, there is very little work dealing with recent developments in the rest of the Americas.

Although the debate over same-sex marriage in the United States has ended, no one seems to know what lies on the horizon. The conversation about what marriage could be like in the future is no longer confined to academics. In his dissent in Obergefell, Chief Justice Roberts linked the constitutionally-mandated legal recognition of same-sex marriage to the possibility that states may also have to recognize multi-person intimate relationships as well to avoid discriminating against plural marriage enthusiasts. The popularity of television shows like TLC’s Sister Wives and HBO’s Big Love suggests that Americans no longer can be dismissive of the possibility that in the foreseeable future, marriage could, and perhaps should, look very different than it does today. Rather than settling the question of whether states ought to abolish marriage, make it more inclusive, contractual, or call it something else, this book exposes readers to some of the normative, legal, and empirical questions that Americans must address before they can deliberate thoughtfully about whether to keep the marital status quo where monogamy remains privileged. Unlike much of the debate over same-sex marriage, they exchange reasons with one another as they discuss marital reform. This book is for ordinary Americans, their elected representatives, and judges, to help them ultimately decide whether they want to continue to define marriage so narrowly, make it more inclusive to avoid discrimination, or have the state leave the marriage business. This edited, interdisciplinary volume contains eight original contributions, all of which illuminate important but often neglected areas of the topic.
