Environmental & Social Justice Challenges Near America’s Most Popular Museums, Parks, Zoos & Other Heritage Attractions - Michael Greenberg - Bog -

This book examines environmental and social justice challenges near America''s most popular heritage attractions. These include over 100 places that host national parks (e.g., Glacier, Yellowstone), zoos (e.g., Bronx, Henry Doorly), urban parks (e.g., Central Park, Fairmount), grand concourses (e.g., 5th Avenue, Massachusetts Avenue), and multiple museums and galleries (e.g., National Gallery, Getty). The book includes measurements of demographics, air quality/distance from hazards, health outcomes, and urban assets in the areas immediately surrounding these heritage sites and compares them with adjacent areas and their host cities or states. It considers the history of justice-related-issues near the sites and evaluates what owners, managers and communities are doing to address gentrification, displacement, the legacy of redlining and other challenges, such as the animal rights movement, climate change/sustainability, and tight budgets. The book examines what some host cities are doing about affordable housing and what some heritage sites have done in establishing constructive relationships with surrounding communities. The book should have two primary audiences. One is the strong and growing social and environmental justice community that has increasingly been scrutinizing parks and other icons for evidence of injustice. This book will interest them, even though all the results do not necessarily support their positions. The second audience is businesses, not-for-profits, and government agencies who manage parks, zoos, museums, and other attractions and need to understand what is happening near their sites and what they can do to be better neighbours.

Representation, Experience, and Metaphysics - Jonathan Knowles - Bog - Springer International Publishing AG - Plusbog.dk

Representation, Experience, and Metaphysics - Jonathan Knowles - Bog - Springer International Publishing AG - Plusbog.dk

This book provides an original perspective on the debate about anti-representationalism and the nature of philosophy. This debate has come to prominence in recent years through the work of people like Richard Rorty, Paul Horwich, Huw Price and Amie Thomasson. It is the first book to explicitly consider this well-known pragmatist kind of anti-representationalism in relation to anti-representationalist views in other areas of philosophy, in particular the philosophy of perception and cognitive science. Taking as its point of departure the neo-pragmatism of Rorty and Price, it critiques the way these (and other) thinkers develop, on this basis, a positive view of philosophy and its remit. By examining the debate about representationalism versus anti-representationalism in perception and cognitive science it provides a different way of understanding the significance of neo-pragmatism, as well as providing an independently interesting perspective on these other debates. A central idea in this perspective involves distinguishing between a world-for-us and a world-in-itself , though in a different way from Kant and many other philosophers. The book extends these reflections to examine questions about realism and the limits of metaphysics for anti-representationalist pragmatism, arguing the view can uphold a common sense kind of realism, as well as the value of distinctively philosophical enquiry in metaphysics.

Gain-based Remedies for Breach of Contract - Daniel Zatorski - Bog - Springer International Publishing AG - Plusbog.dk

Gain-based Remedies for Breach of Contract - Daniel Zatorski - Bog - Springer International Publishing AG - Plusbog.dk

This book focuses on an emerging problem in English contract law: what should be done when a party has been unjustly enriched as the result of a breach of contract but there is no measurable loss suffered by said party? Two rulings are at the heart of the book: Wrotham Park Estate v Parkside Homes and Attorney-General v Blake. These two cases can be said to have established gain-based remedies in English contract law. However, the principles that underpin these remedies are not entirely clear and are subject to debate. This book analyses these principles through the lens of compensatory and restitutionary approaches. Moreover, it applies a comparative analysis of these approaches through the lens of the civil law jurisdiction in Poland. Since the term ''compensation'' is not a universal concept, the book distinguishes between two rationales in the compensatory analysis. The first, reparative compensation, is defined as a form of monetary recompense for loss or damage actually suffered. The second, substitutive compensation, represents a monetary equivalent to a right that a person has been deprived of or denied. Both rationales require the application of a broad notion of loss in order to make gain-based remedies workable in both English and Polish law. In contrast, ''restitution'' states that a person cannot be permitted to profit from their own wrongdoing. Based on this principle, the book argues that gain-based remedies could be applied under Polish law through the rules of unjust enrichment. However, in order to do so, a broader understanding of the subtraction prerequisite (the enrichment being at the aggrieved party''s expense) would have to be adopted. The book concludes that unjust enrichment is a more natural way of implementing gain-based remedies in civil law jurisdictions.

Global Governance of Education - Christian Ydesen - Bog - Springer International Publishing AG - Plusbog.dk

Global Governance of Education - Christian Ydesen - Bog - Springer International Publishing AG - Plusbog.dk

This book examines the educational role of three international organizations created as part of the post-World War II multilateral architecture: the United Nations Educational, Scientific and Cultural Organization (UNESCO), the World Bank, and the Organisation for Economic Co-operation and Development (OECD). These organizations have significantly promoted and shaped education as a fundamental feature of the modernization of society and contributed to the globalization of educational norms, policies and technologies. Drawing on primary source materials and interviews, the book provides novel perspectives to the literature on the global governance of education by focusing on the historical entanglements, relations and power struggles between these three organizations, rather than treating them separately. The study sheds light on the homogenizing effects of globalized educational policy-making and the shifting power dynamics in the global governance of education. ‘This book makes a very distinctive and important contribution to the literature that critically analyses the influence of the global agencies on education globally; it goes beyond the standard discursive analyses of policy texts to also explore the history of those organisations through archival research and in-depth interviews of the key personnel. What emerges is a powerful analysis which locates those agencies within their historical epochs and shines a light on their tensions and micro-politics, both internally and between organisations.’ Paul Morris, Professor of Comparative Education, Institute of Education, University College London, UK‘A must-read historical account of the intermingling, boundary setting and competition between the three big intergovernmental organizations (IOs) in education: OECD, UNESCO, and the World Bank. Different from other scholars that document how these IOs have transformed themselves in response to external and internal changes, Elfert and Ydesen draw attention to the relational aspect: how have these three IOs navigated conflict, carved niches, and used and abused each other to amplify and expand their own mission? How have they done so in an environment that is crowded with intergovernmental and international organizations, each with a claim to govern education globally?’Gita Steiner-Khamsi, Professor of Comparative and International Education, Teachers College, Columbia University; UNESCO Chair of Comparative Education Policy of the Geneva Graduate Institute of International and Development Studies'This volume is a thoughtful and timely work of scholarship. Understanding the roles of UNESCO, the OECD and the World Bank is central to understanding contemporary education in global perspective. Elfert and Ydesen’s historical analysis sets out in rigorous detail how these organisations have evolved, and what has shaped and driven this evolution. The historical analysis is complemented bycontemporary interview data, facilitating an actor-level analysis as well as a broader picture. The book is conceptually and theoretically rich while being accessibly written; the authors manage complexity remarkably well. For anyone interested in global governance and the role of international organisations, or anyone who wants to understand in general how global educational agendas have developed and converged, this book is a most valuable read.'
